These Terms of Use apply to your use of herdsmangrouptec.site and to services provided by Herdsman Group Pty Ltd (ABN 64 703 631 663, ACN 703 631 663) (“we”, “us”, “our”). By using this website you agree to these terms. If you do not agree, please do not use the website.
2. Use of this website
The information on this website is general information about our business and services. It is not professional, financial or legal advice and should not be relied on as such. We take care to keep it accurate and current but do not guarantee that it is complete or free from error.
You must not use this website in a way that is unlawful, that interferes with its operation, or that infringes the rights of any other person.
3. Engagements and services
Nothing on this website is an offer to provide services. Each engagement is governed by a written scope that sets out the work, timing and fees, together with these terms. If the written scope conflicts with these terms, the written scope prevails to the extent of the conflict, except where that would reduce your rights under the Australian Consumer Law.
Fees are payable as set out in the written scope. Any change to the agreed work will be confirmed in writing before it is carried out.
4. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), including that services will be provided with due care and skill, will be reasonably fit for any purpose you have made known to us, and will be supplied within a reasonable time.
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited.
5. Intellectual property
All content on this website, including text, graphics, layout and the Herdsman Group name and mark, is owned by or licensed to Herdsman Group Pty Ltd and is protected by Australian copyright and trade mark law. You may view and print pages for your own personal or internal business use. You must not otherwise reproduce, adapt, publish or distribute any content without our prior written consent.
Ownership of documents and materials prepared for you in the course of an engagement is set out in the written scope for that engagement.
6. Limitation of liability
To the maximum extent permitted by law, and subject to section 4 of these terms:
- we are not liable for any loss or damage arising from your use of, or reliance on, information on this website;
- we are not liable for any indirect or consequential loss, or for loss of profit, revenue, data or opportunity;
- where our liability for failure to comply with a consumer guarantee can lawfully be limited, it is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
7. Third parties
Where we coordinate suppliers, contractors or partners on your behalf, those parties remain responsible for their own goods and services under their own terms. We will pass on information and act on your instructions in dealing with them, as set out in the written scope.
8. Termination
We may suspend or restrict access to this website at any time without notice. Either party may end an engagement by written notice as provided in the written scope, or, if the scope is silent, on 14 days’ written notice. You must pay for work properly performed up to the date of termination. Sections 4, 5 and 6 continue to apply after termination.
9. Governing law
These terms are governed by the laws of the State of Victoria, Australia (VIC). You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them.
10. Changes and contact
We may update these terms from time to time by publishing a new version on this page. The version in force when you use the website, or when an engagement is agreed, applies.
